In Robertson v McDonald's Australia Limited (No 3) [2024] ICQ 009, the appellant, B Robertson, filed two applications (C/2023/29 and C/2023/31) seeking interlocutory relief during an ongoing appeal against McDonald's Australia Limited. The appellant had a history of filing numerous interlocutory applications and was previously directed to consolidate these matters. The appellant’s attempt to file additional applications without leave and requests for continuance to seek legal advice were also rejected due to lack of substantiating reasons and the resultant ongoing delays. Consequently, the court concluded that continuing the appeals without further delay was in the interests of all parties.
