Ryschka v JW & MM Haylock Pty Ltd [2024] QDC 100

In Ryschka v JW & MM Haylock Pty Ltd [2024] QDC 100, the District Court of Queensland dismissed the plaintiff Glen Jeffrey Georg Ryschka's application to amend prior court orders pertaining to his case against JW & MM Haylock Pty Ltd. The central issue of the case involved expert electrical evidence related to a swimming pool, with the amount in dispute being approximately $28,000. The plaintiff sought to extend deadlines for filing new expert reports and amended pleadings; however, Judge Porter KC DCJ dismissed the application due to procedural fairness and the plaintiff’s failure to comply with initial deadlines set by Judge Andreatidis KC. The court highlighted the disproportionate efforts expended relative to the small claim amount and noted the plaintiff's difficulties, including changes in legal counsel. In concluding the application, the court ordered the plaintiff to pay the defendant’s costs on a standard basis, citing substantial unfairness imposed upon the defendant if the timetable were adjusted.
