The court highlighted the disproportionate efforts expended relative to the small claim amount and noted the plaintiff's difficulties, including changes in legal counsel. In concluding the application, the court ordered the plaintiff to pay the defendant’s costs on a standard basis, citing substantial unfairness imposed upon the defendant if the timetable were adjusted.
