In Saville v Council of the City of Gold Coast [2024] QLC 12, the Land Court of Queensland considered an appeal by Jacqueline Saville against the Council's categorisation of her property at 59/28 Fortune Street Coomera. Saville contended that the property should be classified as "1T Residential 1" rather than "2T Residential 2". However, the appeal was dismissed due to procedural issues. The Council’s decision was issued on 27 May 2022, but the Notice of Appeal was not filed until 12 April 2024, well beyond the 42-day limit set by the Local Government Regulation 2012 (Qld). The court confirmed that it lacked the jurisdiction to extend the filing period and dismissed the appeal accordingly.
