In SCA v Commissioner of Police [2024] QDC 57, the District Court considered an appeal regarding an order of costs following the dismissal of a domestic violence charge against SCA. The magistrate had refused SCA's application for costs after finding no offence had occurred. SCA appealed under section 222 of the Justices Act 1886, arguing that the magistrate erred in not awarding costs in her favour. The District Court, presided over by Long SC, DCJ, found in favour of SCA, setting aside the original decision and ordering the complainant to pay SCA costs in the amount of $1,750.00. The court reasoned that a wrongful exercise of discretion regarding costs occurred and recognized the need to compensate SCA for her legal expenses due to the successful defence.
