In Singleton v Lockyer Valley Regional Council [2024] QCA 103, Darrell Singleton (second appellant) sought leave to appeal a District Court decision related to the disposal of his chattels that were removed from a property owned by Steven Kenefick (first appellant). Kenefick, under an enforcement notice from Lockyer Valley Regional Council (the council) for violations of development regulations, did not comply, leading the council to remove various items from the property, including Singleton's belongings. Both Singleton and Kenefick challenged the council’s actions in the Magistrates Court but were unsuccessful. They appealed to the District Court, which also dismissed their case. Singleton's subsequent application for leave to appeal to the Court of Appeal was denied, with judges Boddice JA and Crow J upholding that there was no significant error in the District Court's judgment that warranted an appeal. Consequently, the Court dismissed Singleton’s application with costs.
