In Stephen Family Pastoral Pty Ltd v Logan City Council & Ors [2024] QPEC 43, the appellant sought to make changes to a development application pending before the Planning and Environment Court of Queensland. The application aimed to include various modifications to the development scheme, as detailed in an affidavit by Natalie June Rayment. The proposed changes involved alterations to gross floor area limits, road access, and account for a road resumption area. However, due to the uncertainty and lack of specificity regarding the scope of the proposed modifications, the court was left unable to exercise discretion. Consequently, Judge Everson DCJ dismissed the application.
