TLR v TUN [2024] QDC 147

In TLR v TUN [2024] QDC 147, the District Court of Queensland dismissed the appellant TLR's appeal against a protection order issued solely against him following cross-applications under the Domestic and Family Violence Protection Act 2012. The appellant argued that the Magistrate failed to adequately weigh his evidence and overlooked an act of domestic violence allegedly committed by the respondent against him. TLR further sought to introduce additional evidence from the Queensland Police, which he contended supported his case by demonstrating the respondent’s propensity for violence. However, the court denied this application, determining the evidence was neither fresh nor sufficiently cogent to prevent a miscarriage of justice if omitted. The appeal was dismissed as the appellant could not establish errors in the Magistrate's factual findings or show that a miscarriage of justice had occurred.
