In WOHB Pty Ltd v Williams & Anor [2024] QDC 94, the Queensland District Court addressed a dispute over an option agreement concerning a property at 62 Rodney Street, Wynnum. WOHB Pty Ltd (the plaintiff), represented by its director Mitchell McIlwain, alleged breaches in the agreement dated March 23, 2018, claiming it was entitled to exercise an option to purchase the property. The Court found that the plaintiff had failed to exercise the option within the five-month period stipulated in the agreement and dismissed the plaintiff's application to amend its claim. Additionally, the Court upheld the defendants' counterclaim, stating that the plaintiff had not completed required works on the property and ordered WOHB Pty Ltd to pay the defendants $24,030.93 for damages incurred.
